Hema Committee Probe Hits Dead End: All 34 Cases Closed After Survivors Decline to Testify, Govt Informs Court

KOCHI: The Special Investigation Team (SIT) has officially closed its probe into all 34 cases that originated from the sensational Hema Committee report, which examined widespread sexual exploitation and other issues within the Malayalam film industry.

In a crucial submission to the Kerala High Court, the state government reported that the investigation was concluded because the survivors, who had initially provided testimonies to the Hema Committee, did not come forward to cooperate or give official statements to the SIT.

Government’s Explanation

The government informed the court that despite providing all possible assistance and support, the individuals who had testified before the committee did not participate in the new investigation. With no official statements or complaints to proceed with, the SIT was unable to continue the probe, leading to the closure of all related cases.

The High Court reiterated its stance that no one should be compelled to provide a statement.

High Court Issues New Directives

While the investigation into past cases is now closed, the High Court has ensured a mechanism remains in place for the future. The court directed that:

  1. The SIT will continue to function as a nodal agency to receive any new complaints of sexual harassment from the film industry.
  2. A new, specific law for the film industry should be enacted, which should be more comprehensive than the existing law on the Prevention of Sexual Harassment (POSH) at the workplace, considering the unique nature of the industry.
  3. Until such a new law is passed, the interim guidelines previously issued by the court will remain in full effect.

This development brings a formal end to the investigation phase of the Hema Committee report’s aftermath, but the court has kept the door open for future complaints and has put the onus on the government to create more robust legislation to protect women in cinema.
